The Force Is My Ally
So, I have news. Excited that I started as a senior regulatory advisor at Messari this week. Readers know I’ve linked to their analysis many times in BlockProf. No better place to sharpen my analytical skills in crypto asset analysis, and a powerful ally for DC policy reform in defense of digital asset freedom and digital asset privacy.
It’s like having The Force as your ally.
Hat tip
I appreciated a hat tip in Jerry Brito’s newsletter this week, back at ya buddy. I follow Jerry, ya’ll should too. https://jerrybrito.com/newsletter
They’ll Never Take Our Freedom
So proud of my friends in DeFi Law this week who wrote a deluge of comment letters into the SEC’s request for comment about a new proposal redefining what it means to be an exchange. The SEC is doing a sneak attack on DeFi by redefining the meaning of exchange to include, well, almost everything that facilitates a trade including simply publishing code.

One argument against this overreach that is particularly compelling comes from Peter Van Valkenburgh at Coin Center. He argues the rule may be a Constitution violation of freedom of speech.
Surely that’s a Hail Mary argument you say? Not at all. The SEC had its rule about conflict minerals disclosure struck was down by the DC Circuit on constitutional first amendment grounds just a few years ago. (Sorry SEC General Counsel, you’re gonna need to work late this weekend.)

DAO LLC?
Don’t forget to login to this American Bar Association event I am moderating on May 6 on Legal Governance of DAOs. All the legends of crypto law are on the panel.
